1. Acceptance of These Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "customer," or "user") and My Tokyo Treasure ("we," "us," or "our"), the operator of mytokyotreasure.com (the "Site"). By accessing the Site, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms in their entirety, you must not use the Site or place an order. Placing an order constitutes your express acceptance of these Terms as in effect on the date of the order.
2. Eligibility
You must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is higher) and have the legal capacity to enter into a binding contract to place an order. By ordering, you represent and warrant that you meet these requirements and that all information you provide is true, accurate, and complete. We reserve the right to cancel any order placed in violation of this section.
3. Nature of Our Products; Fixed Gift Boxes; Substitutions
My Tokyo Treasure sells curated boxes of Japanese snacks, confectionery, and related goods. You expressly acknowledge and agree to the following:
- Fixed gift boxes have non-selectable contents. The contents of our Birthday Box and Anniversary Box are curated by us and are fixed: customers cannot choose, exclude, or exchange individual items (other than the Birthday Box style selection: Japan Culture, Kawaii, or Anime Fun). No refund, replacement, or exchange will be provided on the basis that you dislike, did not expect, already own, or have previously received any item contained in a fixed gift box.
- Perceived value is subjective. Any statement of retail value is an estimate based on Japanese domestic pricing and is provided for illustration only. We make no representation or warranty regarding the resale, market, or perceived value of box contents in your country.
- Substitution rights. Product availability in Japan is seasonal and changes rapidly. If an item you selected for a customisable box becomes unavailable, we reserve the right to substitute an item of the same category and equal or greater value without prior notice. Such substitution does not constitute grounds for cancellation, refund, or dispute.
- Duplicates are possible. If you order multiple boxes, or order across different periods, boxes may contain identical or similar items.
- Images are illustrative. Photographs on the Site are for illustration only. Actual items, packaging, flavours, sizes, and colours may vary, including due to manufacturer packaging changes outside our control.
4. Food Safety, Allergens & Consumption — Important Notice
Our boxes contain food products manufactured in Japan for the Japanese domestic market. By ordering, you expressly acknowledge and accept the following:
- Labelling is in Japanese. Ingredient lists, allergen declarations, nutrition information, and expiry dates on the products are printed in Japanese and may not comply with the labelling regulations of your country. We do not provide translations, and we accept no liability arising from your inability to read product labels.
- Allergen risk is assumed by you. Products may contain, or may be manufactured in facilities that also process, common allergens including but not limited to: peanuts, tree nuts, milk, egg, wheat/gluten, soy, sesame, fish, and shellfish. If you or the recipient has any food allergy, intolerance, or dietary restriction (including religious dietary requirements), you order entirely at your own risk. We cannot and do not guarantee that any product is free from any allergen.
- You are responsible for gift recipients. If you send a box to a third party, you are solely responsible for ensuring the contents are suitable and safe for that recipient, and you agree to indemnify us against any claim by the recipient.
- Shelf life. We ship products with reasonable remaining shelf life, but transit and customs delays are outside our control. Best-before dates that pass during a transit or customs delay do not entitle you to a refund.
- Heat-sensitive items. Chocolate and other heat-sensitive products may soften, melt, or change texture in transit, particularly during warm months. Such cosmetic changes do not render a product defective and are not grounds for a refund or replacement.
5. Pricing, Payment & Errors
All prices are displayed in US Dollars (USD) unless otherwise stated and are subject to change at any time without notice. The price applicable to your order is the price displayed at checkout at the time of purchase. We accept major credit and debit cards (Visa, Mastercard, and American Express) as well as Apple Pay and Google Pay, with payments processed by Stripe, Inc. We never see or store your full card details.
- By submitting an order you authorise us (via Stripe) to charge the full order amount, including shipping, to your selected payment method.
- Any currency conversion fees, foreign transaction fees, or exchange-rate differences applied by your card issuer or bank are your sole responsibility.
- Pricing errors. Despite our best efforts, pricing or product information on the Site may occasionally be inaccurate due to technical or human error. We reserve the right to cancel any order placed at an erroneous price — even after order confirmation and payment — in which case we will notify you and issue a full refund of the amount paid. A confirmation email does not obligate us to fulfil an order affected by an error.
- We reserve the right to refuse or cancel any order where we suspect fraud, unauthorised use of a payment method, resale intent, or abuse of promotions.
6. Chargebacks & Payment Disputes
If you have any problem with an order, you agree to contact us and give us a reasonable opportunity (at least 14 days) to resolve the issue before initiating a chargeback or payment dispute with your card issuer.
A chargeback filed on an order that was delivered as described, or filed without first contacting us, will be treated as a bad-faith dispute. In such cases we reserve the right to: (a) contest the chargeback with full evidence including tracking data, delivery confirmation, and correspondence; (b) suspend or permanently close your account; (c) refuse future orders; and (d) recover from you our reasonable costs, fees, and losses arising from the dispute to the extent permitted by law.
7. Order Acceptance & No Cancellation
Your order is an offer to purchase. Our acceptance occurs only when we dispatch the goods; a confirmation email acknowledges receipt of your order but does not constitute acceptance.
- All orders are final upon placement. Because we begin sourcing and hand-packing immediately, orders cannot be cancelled or withdrawn by you for any reason, including change of mind, ordering error on your part, or dissatisfaction with delivery estimates. Please review your order carefully — including box contents, quantities, and the delivery address — before completing checkout.
- Sole exception. The only circumstances in which an order may be refunded or replaced are those set out in Section 11 (Claims Procedure) — that is, where there is a demonstrable problem with the products that was caused by us. No other remedy or cancellation right is offered, subject only to any non-waivable statutory right under Section 23.
- Address or content changes must be requested via our contact form as soon as possible and can only be applied before dispatch. We are not responsible for changes requested but not confirmed by us in writing before dispatch.
- Our cancellations. We may cancel any order (with a full refund) for reasons including product unavailability, inability to ship to your destination, pricing or listing errors, suspected fraud, or violation of these Terms.
8. Shipping, Delivery & Risk of Loss
We ship worldwide from Japan. Shipping fees and estimated transit times are shown at checkout and are estimates only, not guarantees.
- Please allow 4–7 business days for hand-packing and dispatch, in addition to carrier transit time. During peak periods (holidays, promotions) preparation may take longer.
- Transit delays caused by carriers, customs inspection, weather, strikes, pandemics, or other events outside our control do not entitle you to a refund or compensation.
- Risk of loss and title pass to you when we hand the package to the carrier. Notwithstanding this, we will assist in good faith with carrier claims for packages confirmed lost in transit as set out in Section 11.
- Proof of delivery is conclusive. Where carrier tracking shows a package as "delivered" to the address you provided, we deem the order delivered. We are not responsible for packages stolen, misplaced, or taken after delivery, or for deliveries accepted by household members, neighbours, reception desks, or mailrooms at your address.
- We may, at our discretion, decline to ship to certain countries, regions, P.O. boxes, or freight forwarders. Orders shipped to a freight forwarder are deemed delivered upon delivery to the forwarder, and all subsequent risk is yours.
- Multi-box orders. An order may contain multiple boxes, each with its own delivery address. Every box is packed and shipped as its own parcel, so shipping is charged in full for each box, based on that box's destination — including where several boxes ship to the same address. We do not combine boxes into one parcel and do not offer combined-shipping discounts. Each box ships separately with its own tracking number. Where a box is sent to a third-party recipient, you remain the customer for that box (see Section 4), and any claim under Section 11 must be made by you, not the recipient.
9. Addresses, Failed & Refused Deliveries
- You are solely responsible for entering a complete, accurate delivery address, including any unit number, postal code, and (where required by the destination country) a reachable phone number. We copy your address exactly as entered.
- Orders that are undeliverable, returned, forfeited, or destroyed due to an incorrect or incomplete address you provided are not eligible for a refund. If the package is returned to us intact, we may offer reshipment at your expense.
- If a delivery attempt fails and you (or the recipient) do not collect the package or arrange redelivery within the carrier's holding period, the package may be returned, destroyed, or forfeited. Such orders are not eligible for a refund. Reshipment, if the package returns to us, is at your expense.
- If you or the recipient refuse delivery for any reason (including refusal to pay customs charges), the order is not eligible for a refund.
10. Customs, Duties & Import Restrictions (DAP)
All shipments are sent DAP (Delivered At Place): international shipments may be subject to import duties, taxes (VAT/GST), brokerage, and customs clearance fees imposed by the destination country. These charges are assessed solely by local customs authorities — we cannot predict, control, or influence their amount — and they are not included in our prices and are solely your responsibility.
- You are the importer of record. It is your responsibility to verify, before ordering, that the products can be lawfully imported into your country. Some countries restrict or prohibit the import of certain food items (for example, products containing meat, dairy, egg, or specific additives).
- If customs authorities seize, confiscate, destroy, delay, or return a shipment — in whole or in part — because of your country's import rules, no refund will be issued. Customs decisions are entirely outside our control.
- We are required to declare package contents and values accurately. We will not falsify customs declarations, undervalue shipments, or mark commercial orders as "gifts." Requests to do so will be refused.
- Gift orders. Where a box is shipped to a third-party recipient, customs charges are typically billed to the recipient before or upon delivery. You are responsible for informing your recipient that a package is coming and for any customs charges incurred. If a recipient refuses to pay customs charges, the shipment is treated as a refused delivery under Section 9 and is not eligible for a refund.
- Checkout acknowledgement. Before payment you are required to confirm your acceptance of this Section at checkout. That confirmation is recorded together with your order.
11. Damaged, Defective, Missing or Lost Items — Claims Procedure
We pack carefully, but transit handling is outside our control. All claims are subject to the following mandatory procedure. Failure to follow this procedure waives the claim.
- Deadline. Claims for damaged, defective, incorrect, or missing items must be submitted via our contact form within 7 days of the carrier's recorded delivery date. Claims made after this window will not be accepted.
- Evidence. Your claim must include your order number and clear photographs of (a) the outer shipping box including the shipping label, (b) the interior packing, and (c) each affected item. Please retain all packaging until your claim is resolved; we may request additional photos or return of the item.
- Remedies. For validated claims we will, at our sole discretion, provide a replacement item, store credit, or a partial or full refund proportionate to the affected items. Minor cosmetic damage to outer product packaging (dents, creases) that does not affect the food itself, and heat-related changes described in Section 4, are not defects.
- Lost packages. A package is considered lost only after the carrier completes its investigation or after 45 days (60 days for surface mail) without tracking movement, whichever is earlier. For confirmed losses we will reship the order or refund it, at our discretion. Packages showing a delivered status are not lost (see Section 8).
- Fraudulent claims. We log all claims. Repeated, inconsistent, or unsupported claims may result in claim denial, account closure, and refusal of future orders.
12. Returns & Refunds — All Sales Final
Because our products are food items and cannot be restocked or resold once shipped, all sales are final. We do not accept returns, and we do not issue refunds for change of mind, taste preferences, dissatisfaction with fixed gift box contents, duplicate items, perceived value, delivery delay, customs charges, or any other reason not expressly provided for in Section 11.
Where a refund is issued, it will be made to the original payment method. Original shipping fees are non-refundable except where the claim arises from our error. Refund processing times depend on your card issuer.
13. Promotions, Discount Codes & Store Credit
- Discount codes and promotions are valid only for the period, products, and conditions stated, cannot be combined unless expressly permitted, have no cash value, and cannot be applied retroactively to existing orders.
- The Loyalty Reward (10% off your second order) applies to the box price only, not to shipping, and is limited to one redemption per account. It is applied automatically at checkout to the next order placed after your first, is non-transferable, has no cash value, and cannot be exchanged, refunded, or reissued once used — including where the order it was applied to is later cancelled or refunded. Accounts created to obtain the offer more than once may have those orders cancelled.
- We may withdraw, modify, or cancel any promotion at any time, and cancel orders that exploit a promotion through multiple accounts or automated means, or that use a discount code distributed in error.
- Store credit issued as a claim remedy is non-transferable, has no cash value, and expires 12 months after issuance unless otherwise stated or prohibited by law.
14. User Accounts
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, whether or not authorised by you. You must notify us immediately of any suspected unauthorised access. We are not liable for losses arising from unauthorised use of your account where we have not been negligent.
Two-factor sign-in and passkeys. You may add a second factor — a code from an authenticator app — or replace your password with a passkey stored on your device. Both are optional, and we recommend at least one. If you use them, you are responsible for retaining access to the device or app that holds them. Losing your only second factor or passkey can lock you out of your own account.
Recovery. If you lose access to a second factor, contact us and we will remove it after verifying that the account is yours — normally by confirming control of the registered email address. We may decline a request we cannot verify to our reasonable satisfaction, because a recovery process that is easy for you is equally easy for somebody impersonating you.
We may suspend or terminate any account, cancel associated orders, and refuse service — with or without notice — for violation of these Terms, fraudulent or abusive behaviour (including abusive conduct toward our staff), bad-faith chargebacks, or unlawful activity.
15. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law;
- Purchase products for commercial resale without our prior written consent;
- Use bots, scrapers, or automated means to access the Site, place orders, or harvest data;
- Attempt to probe, breach, or test the security of the Site, or interfere with its operation;
- Impersonate any person, misrepresent your identity, or provide false information;
- Create multiple accounts to circumvent restrictions, promotion limits, or bans.
16. Reviews & User Content
By submitting a review, photo, or other content to the Site, you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable licence to use, reproduce, adapt, publish, and display that content in connection with our business, including marketing. You represent that your content is your own, is accurate, and does not infringe any third-party rights. We may moderate, edit for length, decline, or remove any content at our sole discretion, and we are under no obligation to publish any submission.
17. Intellectual Property
All content on the Site — including text, images, photographs, logos, graphics, page designs, and software — is owned by or licensed to My Tokyo Treasure and protected by copyright, trademark, and other intellectual property laws. Third-party product names and brand packaging appearing in our photographs remain the property of their respective owners; their appearance does not imply endorsement of or by My Tokyo Treasure. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.
18. Third-Party Services
Payments are processed by Stripe, Inc. and deliveries are performed by independent carriers. The Site is hosted on Amazon Web Services; transactional email is sent by Amazon SES (we use both Amazon SES and Resend and may switch between them); and sign-in pages use Cloudflare Turnstile to distinguish people from automated scripts. Each operates under its own terms and privacy policy, and Section 4 of our Privacy Policy explains what each one receives. The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of any third party, and a link does not imply endorsement.
19. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT PRODUCT DESCRIPTIONS, PRICING, OR OTHER CONTENT IS ACCURATE, COMPLETE, OR CURRENT.
20. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: (A) IN NO EVENT SHALL MY TOKYO TREASURE, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO ANY ORDER SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THAT ORDER.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud.
21. Indemnification
You agree to indemnify, defend, and hold harmless My Tokyo Treasure and its owners, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your breach of these Terms; (b) your violation of any law or third-party right; (c) content you submit to the Site; (d) claims by any gift recipient of an order you placed; or (e) your importation of products into your country.
22. Force Majeure
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including without limitation natural disasters, earthquakes, typhoons, fire, flood, epidemics or pandemics, war, terrorism, civil unrest, labour disputes or strikes, carrier or postal service disruptions, customs actions, government orders, embargoes, power or internet failures, or supplier failures. Affected obligations are suspended for the duration of the event. If fulfilment becomes impossible, our sole obligation is to refund amounts paid for unfulfilled orders.
23. Your Statutory Rights
Some jurisdictions grant consumers rights that cannot be excluded, restricted, or modified by contract. Nothing in these Terms is intended to exclude, restrict, or modify any non-waivable statutory right you may have under the mandatory consumer protection laws of your country of residence. To the extent any provision of these Terms conflicts with such a non-waivable right, that provision applies to you only to the maximum extent permitted by law.
24. Governing Law & Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them or any order (including non-contractual disputes), are governed by the laws of Japan, excluding its conflict-of-law rules. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
Before commencing any formal proceeding, you agree to first contact us and attempt in good faith to resolve the dispute informally for at least 30 days. Subject to any non-waivable statutory right to bring proceedings in your own country, the Tokyo District Court in Japan shall have exclusive jurisdiction as the court of first instance over all disputes arising from these Terms. To the extent permitted by law, any claim must be brought within one (1) year of the event giving rise to it, and disputes shall be resolved on an individual basis only — not as part of any class, collective, or representative action.
25. Changes to These Terms
We may revise these Terms at any time by posting the updated version on this page with a revised "Last updated" date. Changes apply prospectively; each order is governed by the Terms in effect at the time it is placed. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
26. General Provisions
- Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign or transfer these Terms or any order without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of our business.
- Entire agreement. These Terms, together with our Privacy Policy and the details of your order, constitute the entire agreement between you and us regarding your use of the Site and your purchases, and supersede all prior communications.
- Language. These Terms are drafted in English. Any translation is provided for convenience only; the English version prevails.
- Headings are for convenience only and do not affect interpretation.
